Proposals to amend the Fiscal Code, approved in the Chamber of Deputies

On November 24, 2020, the Chamber of Deputies adopted and submitted for approval to the Secretary General for the exercise of the right of referral on the constitutionality of the law, two draft laws in the fiscal field, which were adopted by the Senate since October last year, but for which the requested emergency procedure was not approved, in the Permanent Bureau of the Chamber of Deputies.

 

According to the legislative procedure, the two laws adopted by the Chamber of Deputies are communicated, before being sent for promulgation, to the Government, the High Court of Cassation and Justice, as well as to the People’s Advocate and are submitted to the Secretary General of the Chamber of Deputies and the Secretary General of the Senate. , in order to exercise the right to refer the matter to the Constitutional Court. At the end of these procedures, the laws are sent to the President of Romania, for promulgation.

 

The two projects adopted by the Chamber of Deputies in the meeting of November 24, 2020, aim:

 

  • Regulation of some aspects of fiscal procedure, by amending and supplementing Law no. 207/2015 on the Fiscal Procedure Code, by proposing measures favorable to the business environment, having as object the improvement of the balance in the relationship between fiscal bodies and taxpayers, simplification of administration procedures of tax receivables, and a better clarity of the text of the law, eliminating non-unitary interpretations either from the tax authorities or from the taxpayers.

 

  • Regulations in the field of profit tax, income tax of micro-enterprises, income tax and compulsory social contributions, income tax obtained in Romania by non-residents, tax on representations of foreign companies established in Romania, value added tax, excise duties and other special taxes, local taxes and fees, by amending and supplementing Law no. 227/2015 on the Fiscal Code
