In the Official Gazette of Romania, Part I, No. 978 of October 23, 2025, Law No. 166/2025 was published, approving Government Emergency Ordinance (GEO) No. 21/2025 for the amendment and completion of Title X of Law No. 227/2015 on the Fiscal Code, as well as for the amendment and completion of certain related legal acts.

Law No. 166/2025 approves GEO No. 21/2025, previously published in the Official Gazette, Part I, No. 300 of April 4, 2025, and introduces the following amendment:
🔸 Amendment to Article VIII
Article VIII is amended to read as follows:
By way of derogation from the provisions of Article VII (1) and (5) of GEO No. 156/2024 on certain fiscal and budgetary measures in the field of public expenditure for the substantiation of the consolidated general budget for 2025, for the amendment and completion of certain legal acts, as well as for the postponement of certain deadlines, as subsequently amended and supplemented,
in the year 2025, public authorities are authorized to organize recruitment competitions or examinations for filling vacant positions related to nurseries built under the Government Programme “Sfânta Ana”, financed through the National Recovery and Resilience Plan (NRRP), Component 15 – Education, Investment 1: Construction, equipment and operationalization of 110 nurseries, as well as under the National Programme for the Construction of Public or Social Interest Facilities.
🔸 Operationalization procedure
When a physical execution stage of at least 75% of the investment objective is reached, the Ministry of Development, Public Works and Administration shall notify the Ministry of Education and Research to initiate the necessary procedures for the operationalization of the nursery.
🔸 Approval of recruitment
The Government shall approve, by memorandum, upon the proposal of the Ministry of Education and Research and with the approval of the Ministry of Finance, the organization of competitions for the vacant positions related to these nurseries, within the personnel expenditure limits approved by the budget.
