New fiscal-budgetary measures – OUG draft law

According to a draft ordinance published on 29 November 2022, from 1 January 2023, the pension point will increase by more than 10% and the minimum guaranteed pension will reach 1,125 lei.

Thus, the document establishes that the pension point will reach the value of 1,785 lei from 1 January, and, starting from 2024, this value will be increased by the average annual inflation rate, plus 50% of the real increase in average gross earnings.

As for the social allowance for pensioners (minimum guaranteed pension), it will be 1,125 lei, starting on 1 January 2023.

Other important measures proposed in the recently proposed document:

  • Increasing the differentiated minimum wage, but only in construction. The currently applicable differentiated minimum wage of 3,000 lei gross will be increased to 4,000 lei gross from 1 January 2023. However, for the agri-food sector, the gross minimum wage will remain at 3,000 lei (i.e. at the level of the gross minimum wage in the country);
  • In the case of people paid the minimum gross wage, 200 lei will be free of wage tax. Thus, those who in 2023 will have the gross minimum wage (3,000 lei) will be exempt from payroll taxes for 200 lei of this money. Basically, the employer will owe payroll taxes on a gross salary of 3,000 lei as on a gross salary of 2,800 lei, but under certain strict conditions;
  • the extension of the suspension of tax facilities for early education – the possibility to deduct from the corporate income tax the expenses for early education, in the amount of maximum 1,500 lei per month for each child, and the fact that the amounts paid by the employer for the early education of the employees’ children are not taxable and not included in the calculation basis of social contributions for pensions and health;
  • the filing of 392 and 393 returns will also be suspended in 2023;
  • the deadline for equipping commercial cash registers will be moved. Company-owned vending machines will have to be equipped with cash registers by 31 December 2023, after which the Government will again postpone the deadline which is now set for the end of this year.
  • The fine point, which should theoretically be 10% of the gross minimum wage in the country, will still be 145 lei in 2023;
  • the updating of some military pensions;
  • a one-off benefit for low-income pensioners. In 2023, pensioners with a total monthly income of up to 3,000 lei will receive a one-off state benefit. The aid will be 600, 800 or 1,000 lei, depending on the beneficiaries’ actual income, and will be paid half in January and half in October;
  • New pension law postponed to 2024;
  • people with disabilities will receive a one-off compensatory allowance, to be paid directly to them or, where applicable, to their legal representatives. The allowance will be between 64 and 368 lei. We underline that the compensation will be granted only once, in January 2023.
  • The 500 euros for children’s education will not be granted in 2023.
