New Rules for Reclaiming Benefits from Health Insurance Funds

CNAS Order No. 1,231/2026, published in Official Gazette No. 606 of July 24, 2026, introduces amendments to the Rules for the Implementation of Government Emergency Ordinance No. 158/2005 on health social insurance leave and benefits.

The amendment concerns Annex No. 10 to the implementation rules and introduces four new categories in the application used to reclaim amounts representing medical leave benefits from the health insurance funds.

What New Categories Are Introduced

After category J1.1, positions J1.2-J1.5 are introduced, allowing the amounts requested by employers for benefits related to temporary incapacity for work to be recorded separately.

The breakdown takes into account the duration of the medical leave and the percentage applied to the calculation base:

  • 55% for medical leave of up to 7 days;
  • 65% for medical leave lasting 8-14 days;
  • 75% for medical leave exceeding 15 days;
  • amounts resulting from recalculation, in situations where the value of the benefit needs to be corrected.

With this addition, the reimbursement application allows for a more detailed breakdown of the amounts requested by employers.

What Employers Should Monitor

The amendment is relevant for employers requesting reimbursement of medical leave benefits from the health insurance funds. Payroll, HR, and financial-accounting departments must use the updated application format and correctly classify the requested amounts under the new categories provided in Annex No. 10.

Correct application of the new categories contributes to clearer record-keeping of benefits and reduces the risk of errors in the documentation submitted for the reimbursement of amounts.

CNAS Order No. 1,231/2026 thus represents an important procedural update for employers who frequently manage medical leave and request reimbursement of benefits covered by the budget of the National Single Health Social Insurance Fund.
