The Government Ordinance (OG) no.21 for the modification and completion of the Law no.95/2006 on health reform, as well as for the modification and completion of some normative acts with impact in the health field was published in the Official Gazette (Patea I) no.87 on 31 January 2023, with applicability from 3 February 2023.
The main amendments concern the following aspects:
▪ in the case of an insured person who works for several employers and who is insured with each of them for holidays and health insurance benefits, the insurance period is 6 months with each employer and the benefits are calculated and paid, as appropriate, by each employer. The basis of calculation for each benefit is only the income earned at each place of employment;
▪ in the case of insured persons who are teachers and work for several employers to supplement their teaching load, the periods of insurance completed in the 12 months preceding the month for which sick leave is granted are used by all employers, and the allowances are calculated and paid by each employer only for the income earned by the insured person at that employer;
▪ insurance periods completed under the legislation of a country with which Romania has concluded international agreements, agreements, conventions or protocols with provisions in the field of health, are assimilated to the contribution period required to benefit from social health insurance leave and allowances;
▪ foreign citizens or stateless persons in special situations, coming from the area of the armed conflict in Ukraine, benefit from social health insurance leave and allowances as Romanian insured persons, under the conditions provided for by the legislation in force.
