On August 29, it was published in the Official Gazette The Emergency Ordinance No. 117 of August 26, 2022 for the amendment and completion of the Law on Paternity Leave No. 210/1999.
Thus, the duration of paternity leave paid by the employer is increased from 5 to 10 working days.
If the father of the newborn child has obtained the certificate of completion of the childcare course, the duration of the paternity leave is increased by 5 working days.
The father can benefit from increased paternity leave for each new-born child, based on the certificate of completion of the childcare course, regardless of when it is obtained.
In addition to persons employed on the basis of a work or service report, the following categories of persons also have the right to paternity leave:
– which carries out activity on the basis of contracts from sports activity
– which carries out activity on the basis of individual labor agreements within cooperatives
– directors who carry out activity based on mandate contracts
– which carries out activity on the basis of management contracts
– who holds a position of public dignity
Failure to grant paternity leave by the employer constitutes a contravention and is sanctioned with a fine from 4,000 lei to 8,000 lei.
