Changes in the use of treasury payment orders
In the Official Gazette no.1164 / 08.12.2021 was published the MF Order no.1459 / 2021 for amending and supplementing the Methodological Norms on the use and completion of the payment order for the State Treasury (OPT) and the electronic multiple payment order (OPME), approved by Order of the Minister of Public Finance no. 246/2005, and amending and supplementing the annex to the Order of the Minister of Public Finance no. 3139/2017 on approving the issuance of government securities for the population, through the operative units of the State Treasury, within the Treasury Program
According to the normative act, the electronic multiple payment order (OPME) can be used, more recently, by individuals registered in the Virtual Private Space (SPV) for operations related to government securities for the population under the Treasury Program, according to Order 1459/2021 .
The main aspects regulated by the Order MF 1459/2021 are:
- Items in the payment order form for the State Treasury (OPT), under the heading “beneficiary”: “for payments made from accounts opened with the State Treasury for other purposes (for example: payment in the accounts of economic operatorsgoods purchased, services provided or works performed to public institutions, transfer of balances of cash accounts of economic operators in bank accounts, transfer of amounts related to salary rights in card accounts opened with banks in the name of employees of public institutions, payments on distribution of fundsand real estate from the forced execution process; transfers related to government securities intended for the population within the Treasury Program, etc.) the name of the beneficiary of the amount shall be entered; “
- The electronic multiple payment order (OPME) can be used by public institutions that are registered in the Register of public entities and by economic operators and entities other than public institutions, for making payments from accounts opened at the units of the State Treasury through which they operate.own activity, as well as by individuals registered in the Virtual Private Space (SPV) for operations related to government securities intended for the population within the Treasury Program.
The form “Electronic multiple payment order (OPME)” can be downloaded from the website of the Ministry of Finance, National Forexebug Reporting System – Public information – Forms, from the portal of the National Agency for Fiscal Administration (ANAF), Online services – Electronic declarations – Download statements or can be made available by the territorial units of the State Treasury.
The form “Electronic multiple payment order (OPME)” is completed and submitted online through the National Forexebug Reporting System by public institutions and, respectively, through the “Declaration Submission” service by economic operators, entities other than institutions as well as through the service of Submission of the single declaration and other SPV-PF forms on the ANAF portal by the natural persons registered in the SPV.
We mention that public institutions, economic operators and other entities can submit online the completed “Electronic Multiple Payment Order (OPME)” form, in compliance with the operating procedure of the National Forexebug Reporting System.
The validation and processing of the form “Electronic multiple payment order (OPME)” submitted online by economic operators, by entities other than public institutions, as well as by individuals is carried out in compliance with the provisions of art. 3 in the head. II of the annex no. 9 – The procedure for on-line submission, validation and processing of the “Electronic Multiple Payment Order (OPME)”, approved by the Order of the Minister of Public Finance no. 517/2016 for the approval of procedures related to some modules that are part of the operating procedure of the national reporting system – Forexebug, with subsequent amendments and completions, except that the receipts related to the submission and validation / rejection of the electronic multiple payment order (OPME) are view via SPV, Messages section.
Completion – important aspects:
In the “Entity type” section, select the option “Public entity” by public institutions that are registered in the Register of public entities, “Other entities” by economic operators and entities other than public institutions or “Individual“ by individuals, after case.
The fiscal identification code of the payer (fiscal registration code, unique registration code, personal numerical code or fiscal identification number, as the case may be) is entered in the “CIF Payer” section;
Under the heading “Beneficiary IBAN Code”, enter the IBAN code related to the budget revenue or expenditure account, the cash account, the subscription account or the account opened with a credit institution in Romania, as the case may be, in which the amount is paid;
Public institutions, economic operators and other entities, as well as individuals may continue to use the payment order for the State Treasury (OPT) to make payments from accounts opened with the units of the State Treasury.
Public institutions, economic operators and other entities have the obligation to check daily the concordance of the operations ordered by means of the form «Electronic multiple payment order (OPME)» with the data entered in the account statement, and in case of material errors generated by the units To the State Treasury, the account holders have the obligation to immediately inform the units of the State Treasury in order to make the necessary corrections.
According to OMF 1459/2021, the responsibility for the concordance between the information displayed in the PDF file of the electronic multiple payment order (OPME) and those in the XML file attached to it rests exclusively with the natural persons who prepared and submitted them through the Single Declaration and other submission service.
