Simplifications related to the customs value of goods – standard changes

The Official Gazette No. 1028 of October 28, 2021 published the ANAF ORDER no. 1518 of September 30, 2021 for amending and supplementing the Norms on authorization to simplify the determination of amounts that are part of the customs value of goods, approved by Order of the President of the National Agency of Fiscal Administration no. 1890/2016.

Authorizations for simplifying the determination of amounts that are part of the customs value of goods are issued by the General Directorate of Customs at the request of interested parties, only for placing the goods, repeatedly and under the same contractual conditions, under customs regime for release for free circulation.

The transmission and processing of applications, as well as the subsequent issuance and management of authorizations, respectively their modification, revocation, cancellation, and suspension, are carried out using the Customs Decision System, developed at the European Union level and made available to economic operators and customs authorities. members of the European Commission in accordance with Article 10 of Commission Implementing Regulation (EU) 2015 / 2.447 of 24 November 2015 laying down rules for the implementation of certain provisions of Regulation (EU) No 1095/2010. Regulation (EC) No 952/2013 of the European Parliament and of the Council laying down the Union Customs Code and Chapter III of Commission Implementing Regulation (EU) 2021/414 of 8 March 2021 on technical arrangements for the development, maintenance and use of electronic systems exchange and storage of information under Regulation (EU) no. 952/2013 of the European Parliament and of the Council. The application for authorization is submitted by the applicant in the EU Traders Portal.

Upon request, the following documents are attached in electronic format:

  • the document certifying the power of attorney for the status of customs representative, if applicable, in accordance with Article 19 (2) of Regulation (EU) 952/2013 of the European Parliament and of the Council of 9 October 2013 laying down the Union Customs Code, hereinafter referred to as code;
  • the criminal record of the applicant;
  • criminal record of the applicant’s employee (s) responsible for the applicant’s customs matters;
  • the criminal record of the person (s) responsible for the applicant or who exercises control over his / her management.
