Parliament has passed the bill establishing the National Investment and Job Creation Program, an initiative that expands tax incentives for the business community and introduces new financial support mechanisms.
Thank you for reading this post, don't forget to subscribe! As an exception to the general framework set forth in the Tax Code (Law No. 227/2015), the new legislation stipulates that profits reinvested in any tangible asset listed in the Fixed Assets Catalog—purchased for the purpose of modernizing production capacity or for new investments—are exempt from tax for a maximum period of five years, provided that the assets remain in the country for the duration of their depreciation.
The new support program is aimed at companies in the agricultural and manufacturing sectors that are undertaking new greenfield investments, expansions, or modernizations.
To benefit from the package of incentives, businesses must meet a series of strict eligibility requirements:
- maintaining at least 9 full-time employees and hiring a minimum of 9 people (within 6 months),
- having no tax debts or being in a state of insolvency, as well as
- committing to a professional training plan.
At the same time, beneficiary companies are required to reinvest at least 15% of their net profit locally within the first three years following the expiration of the incentives and to maintain the average number of employees for at least 18 months.
The financing component of the legislative package includes state-guaranteed lending mechanisms and national aid. Thus, for loans intended for investments, the state will provide guarantees of up to 70% of the loan amount, with the cap rising to 90% for projects in rural areas, and for greenfield investments, bank and administrative fees will be subsidized through a dedicated state aid scheme.
With an implementation period of five years, the program will be managed by the Ministry of Finance and is set to take effect after it is signed into law by the President of Romania and the legislation is published.
