Recent legislative changes in fire safety introduce a new transparency obligation for administrators and managers of institutions that manage publicly accessible spaces. Through Emergency Ordinance no. 17/2026, which amended Law no. 307/2006, administrators are now required to inform the public via posting on their official promotional websites regarding compliance with fire safety requirements in buildings or spaces used by clients, visitors, or other beneficiaries. The Bihor Inspectorate for Emergency Situations publicly presented this legislative update, emphasizing that the information must be provided online through official channels.
In practice, this obligation applies to categories of buildings and facilities that fall under fire safety approval and/or authorization according to Government Decision no. 571/2016. Depending on purpose, area, capacity, or height, this may include:
- Commercial spaces such as shops, supermarkets, shopping centers, restaurants, cafés, or bars
- Tourism spaces such as hotels, guesthouses, hostels, and other accommodation units
- Public access cultural or event spaces, such as theaters, cinemas, event centers, or event tents
The regulation also covers other relevant categories, including educational buildings, parking facilities, hospitals, fuel stations, and certain spaces in collective residential buildings.
The new rules significantly change compliance reporting. It is no longer sufficient for the fire safety authorization status to be known internally; it must be communicated to the public clearly and accessibly. Administrators must indicate whether the space has a fire safety authorization or operates without one when such authorization is mandatory.
Non-compliance is subject to fines ranging from 5,000 to 10,000 RON, according to authorities. For companies operating in retail, HoReCa, tourism, services, entertainment, or publicly accessible spaces, posting this information on websites should be treated as an integral part of legal compliance policies and responsible communication.
