Leave without pay

Leave without pay is a form of suspension of the individual employment contract by agreement of the parties.

This type of leave is regulated by Law 53/2003 – Labour Code in art.153. Thus, employees may request, for the resolution of personal situations, leave without pay.

On the basis of the employee’s request, the employer draws up the decision to suspend the individual employment contract.

According to HG 905/2017, the suspension is registered in Revisal and sent to the Territorial Labour Inspectorate no later than the day before the date of suspension/the date of termination of the suspension.

The duration of unpaid leave is established by the applicable collective labour agreement or by the internal regulation of each company.
