Jobseeker profiling procedure

In the Official Gazette (Part I) no.44 of 16 January 2023 was published the ANOFM Order no.1073 for the modification and completion of the Procedure for profiling job seekers registered with the employment agencies, approved by the Order of the President of the National Agency for Employment no. 11/2018.

Depending on the level of employability in which he/she is classified, a person may benefit from one or more measures to stimulate employment.

 

According to the document, profiling is the activity through which the county and Bucharest employment agencies identify the profile of job seekers registered in the records of the county or Bucharest employment agencies and the classification in the employability levels: easy employable, medium employable, hard employable and very hard employable, as well as to identify the activation measures, respectively the measures for stimulating employment that can be granted, under the law, mainly so that these persons become employed persons on the labour market.

The profiling of jobseekers highlights weaknesses in the risk of people becoming long-term unemployed, and the profiling result is used to support decisions to adapt and, where necessary, update the set of activation measures, i.e. measures to stimulate employment that can be provided, mainly according to the needs of the individuals.

In order to carry out profiling and to fit into the employability levels provided by law, as well as to identify the activation measures, i.e. the measures for stimulating employment that can be granted, under the terms of the law, mainly for people to become employed persons on the labour market, the present procedure establishes:

a) criteria for placing jobseekers in employability levels;

b) the profiling method, including the mathematical model for establishing the profile of each jobseeker and their inclusion in one of the employability levels;

c) the employment incentive measures which may be provided, in particular, for persons in each employability level.

 

According to the new law, the criteria for job seekers to be classified in the employability levels are:

 

  • geographical: locality. Locality means: municipality, city, village seat of the commune, component village within the commune and village belonging to the municipality or city, in accordance with the provisions of Law no. 351/2001 regarding the approval of the National Territorial Development Plan – Section IV – Network of localities, with subsequent amendments and additions;
  • level of studies;
  • age, respectively the following age groups: up to the age of 45 and at least 45;
  • belonging to a vulnerable group or group with special needs. For the application of this criterion, it will be considered if the person falls into at least one of the following categories: long-term unemployed, person with disabilities, person of Roma ethnicity, person released from detention, person subject to the risk of being trafficked, young person with risk of social marginalization or refugee or person under another form of international protection;
  • occupational: seasonal nature of the activity performed, professional experience in the last 5 years, professional experience in the targeted occupation in the last 3 years, qualification/occupation, relevant qualification/occupation;
  • personal, such as: problems related to housing, in the process of changing the address, urgent household activities, etc.;
  • family, such as: situations that prevent or complicate the employment process, a sick relative who needs care, children who could not be enrolled in daycare or kindergarten, etc.;
  • medical, such as: chronic patients, scheduled operations, recovery periods, medical restrictions regarding the activities he can carry out, etc.;
  • the availability to work in a shorter time horizon, to participate in professional training programs, to work in a different occupation than the one for which he has experience or training;
  • the motivation to get into work.

 

Depending on the level of employability, the measures to stimulate employment that are granted, in compliance with the legal provisions, mainly to persons belonging to the employability level are:

 

– for the employability level “easily employable”:

 

a) information and professional advice;

b) mediation;

c) advice and assistance for starting a self-employed activity or starting a business;

d) financial entitlements in the form of bonuses or other sums of money granted to individuals. By way of example, without being limitative: mobility bonuses, supplementing employees’ wage income, insertion bonuses, activation bonuses;

e) employment subsidies;

 

– for the “medium employability” occupability level”:

 

a) information and professional advice;

b) mediation;

c) vocational training;

d) assessment and certification of professional skills acquired by means other than formal training;

e) advice and assistance for starting self-employment.

f) business start-up assistance;

g) financial entitlements in the form of bonuses or other sums of money granted to individuals. By way of example, without being limitative: mobility bonuses, supplementing employees’ wage income, insertion bonuses, activation bonuses;

h) employment subsidies;

 

– for the employability level “hard to employ”:

 

a) information and professional advice;

b) vocational training;

c) assessment and certification of professional skills acquired by means other than formal training;

d) mediation;

e) financial entitlements in the form of bonuses or other sums of money granted to individuals. By way of example, without being limitative: mobility bonuses, supplementing employees’ wage incomes, insertion bonuses, activation bonuses;

f) employment subsidies, including in the framework of programmes aimed at the temporary employment of unemployed workers;

 

– for the employability level “very hard to employ”:

 

a) information and professional advice;

b) mediation;

c) guidance with a view to inclusion in the Ministry of Education’s “Second Chance” programme;

d) vocational training;

e) assessment and certification of professional skills acquired through other than formal means;

f) financial entitlements in the form of bonuses or other sums of money granted to individuals. By way of example, without being limitative: mobility bonuses, supplementing employees’ wage income, insertion bonuses, activation bonuses;

g) employment subsidies, including in the framework of programmes aimed at temporary employment of the unemployed.

 

Please note that persons falling into one of the employability levels provided by law may benefit, under the law, from one or more measures to stimulate employment, for the respective level of employability, as well as, where appropriate, under the law, other services or measures to stimulate employment provided by law.

Each job seeker registered in the records of the county or Bucharest employment agency shall be electronically classified, by means of ANOFM’s computer technology and applications, in one of the employability levels mentioned above.

 

We mention that profiling is carried out in accordance with the following steps:

 

1. administrative profiling is carried out according to Annex 1, obtaining an initial score for the administrative criteria for each occupation in which the person has experience or professional training;

2. a questionnaire is filled in to assess the jobseeker’s situation and an additional score is determined for each occupation in which the jobseeker has experience or professional training. The determination of the additional score is based on the evaluation method provided in Annex no. 2. The model questionnaire is provided in Annex no. 3 of the Order;

3. the answers of the jobseeker are evaluated and the additional score for each section is adjusted according to point no.3 of Annex no.2, obtaining a final additional score for each occupation in which the person has experience or professional training;

4. the initial and the final additional points are added together to give the total score. By comparing the total score obtained with the intervals specified in the table in point 5 of Annex No 2, the person’s employability level is determined for each occupation in which the person has professional experience or training;

5. the general employability level of the person is determined by choosing the most favourable level in terms of employment opportunities. In this sense “easily employable” will be considered the most favourable level, while “very difficult to employ” will be considered the most unfavourable level.

 

The profiling and classification in the employability levels of job seekers is carried out when registering job seekers in the records of the county or Bucharest employment agency, according to chapter II of this procedure.
