Verification of the Eligibility of Non-Governmental Organizations for Monitoring Activities in Social Services

The Ministry of Labour, Family, Youth and Social Solidarity (MMFTSS) has established a clear procedure for verifying the eligibility of non-governmental organizations (NGOs) that wish to participate in monitoring activities regarding the rights of beneficiaries of residential social services.

According to this procedure, eligible NGOs, as declared under the applicable provisions, shall conclude collaboration protocols with MMFTSS for conducting monitoring activities, in accordance with Article 11(3) of Law No. 197/2012 on quality assurance in social services and Article 33(2) of the Convention on the Rights of Persons with Disabilities, ratified by Romania through Law No. 221/2010.

Eligibility Criteria and Procedure

The verification of NGO eligibility is carried out by an evaluation committee established within MMFTSS, composed of five members appointed by ministerial order. Additionally, a separate appeals committee of five other representatives is formed to resolve any objections submitted regarding the evaluation decisions.

NGOs active in the field of human rights or representing service beneficiaries may apply for collaboration protocols, provided they meet all eligibility criteria stipulated by the procedure.

Principles and Guarantees

The selection of NGOs follows the principles of transparency, competitiveness, and equal treatment. The activities undertaken under the signed protocols are carried out independently, in compliance with the applicable laws and within the limits of the collaboration agreement.

MMFTSS also commits to respecting the operational and decision-making autonomy of the NGOs involved, ensuring a partnership framework based on accountability, professionalism, and mutual respect.
