Starting from October 9, 2025, the Labour Code has been supplemented by Law no. 149/2025, introducing new provisions regarding work-from-home and teleworking arrangements for parents who care for children. Previously, this benefit was limited to parents of children up to 11 years old, but the new regulation expands access and increases the number of days granted in special cases.
Initially, the law allowed parents or legal guardians of children up to 11 years old to request four days of remote work per month. If both parents are employed, only one of them could benefit from this right during the same period, based on a self-declaration. Additionally, the employee was required to provide, at their own expense, the necessary tools to carry out their work remotely.
What’s New in Law 149/2025: Additional Support for Families with Children with Special Needs
The new regulation grants extended rights to employees who care for children with disabilities or are in special family situations, such as:
- 8 days of remote work or teleworking per month for parents of children with disabilities up to 18 years old. This is an exception to the standard 4-day limit.
- An additional 2 days per month for each extra child, if the employee is caring for two or more children with certified disabilities.
- The same right also applies to parents of twins, triplets, or other multiples, up to 18 years old, even if the children are not classified as having disabilities.
The employee’s request must be accompanied, where applicable, by the child’s disability certificate, issued according to the law.
These amendments aim to provide real support for families facing significant challenges, ensuring better work-life balance. At the same time, employers must review their internal telework policies and carefully manage such requests, taking into account the nature of the job and legal obligations.
