Employers in education, agriculture, law offices, and NGOs without an OSH authorization risk fines of up to 10,000 lei

Employers in educational institutions, agricultural companies, law firms, notary offices, and non-governmental organizations (NGOs) are legally required to obtain an occupational safety and health (OSH) operating authorization before starting their activities.
Failure to obtain this authorization constitutes a contravention and is punishable with a fine between 5,000 and 10,000 lei, according to Article 39, paragraph (2) of Law no. 319/2006.

Who grants the authorization and who is exempt?
The Territorial Labour Inspectorates (ITM) are responsible for authorizing certain legal entities, including those mentioned above. Exempt from this procedure are:

  • companies authorized under Law no. 265/2022 regarding the Trade Register;
  • sole proprietorships (PFA), individual enterprises, and family enterprises regulated by GEO no. 44/2008.

Obtaining the OSH authorization involves submitting a simple file to the ITM containing key documents on the legality and safety of the activity. The legal deadline for issuing the certificate is only 5 working days.

Attention: serious irregularities can lead to the suspension of the activity, which may only be resumed after deficiencies are remedied and a new authorization is granted.
