According to a project, put up for debate in the Senate, the energy performance certificates of buildings will be included in a National Register, which will also have a public information section, through which interested citizens will be able to check their validity in front of the computer.
In addition, penalties for falsifying energy performance certificates will be increased.
Thus, the National Register of Energy Performance Certificates for Buildings, to be developed by the Ministry of Public Works, Development and Administration, will include, in electronic format, all certificates issued by energy auditors for buildings or certified technical experts.
The platform will also have to include a public section where certificate holders can verify the authenticity of the certificates.
Also, in order to reduce the number of false energy certificates, which, according to the initiators, is worryingly high, it is now proposed to increase the penalties applicable to those who falsify these documents.
More specifically, the fines for falsifying energy certificates could reach up to 10,000 lei, and in the case of energy auditors or technical experts who are at the second offence, the penalty will be suspension of the right to practice for a period of between three and four years.
According to Law 372/2005, the certificate must be presented when selling or renting a dwelling (in copy), so that the potential buyer or tenant, as the case may be, is aware of the energy performance of the dwelling to be bought or rented, and at the conclusion of the sale-purchase contract, the owner is obliged to transmit the certificate, in original, to the new owner.
Moreover, the sale or rental advertisements must also contain information on energy performance. For lack of this information, from 2020, the owner of the house or the estate agents can be fined up to 2,500 lei.
