The Emergency Ordinance (OUG) no.157/2022 for the establishment of a state aid scheme in the form of a grant to agricultural producers who established crops in autumn 2021 that were affected by soil drought was published in the Official Gazette no.1191 of 12 December 2022.
According to the normative act, in the case of agricultural producers who are also holders of a drought insurance contract and beneficiaries of Measure 17.1 of the 2014-2020 PNDR for the drought insurance premium, and the compensation from insurance companies calculated per ha added to the grant per ha granted under this scheme leads to an excess of 80% of the eligible expenditure, they shall refund the countervalue of the amount representing the excess in question with the payment of the market interest.
In addition, in the case of agricultural producers who are also beneficiaries of Measure 17. 1 of the NDP 2014-2020 for drought insurance premium, who have received amounts from insurance companies representing drought compensation calculated per ha, prior to the date of submission to the DAJ (county agricultural directorates) of the grant application, they are obliged to mention in the payment applications, in the Declarations and commitments section, the amounts received from the insurance companies, and the DAJ verifies that the conditions laid down have been met, determines, where appropriate, the amounts due to the beneficiaries, makes payments to them, or the amounts to be reimbursed with the payment of market interest.
