Employers in educational institutions, agricultural companies, law firms, notary offices, and non-governmental organizations (NGOs) are legally required to obtain an occupational safety and health (OSH) operating authorization before starting their activities.
Failure to obtain this authorization constitutes a contravention and is punishable with a fine between 5,000 and 10,000 lei, according to Article 39, paragraph (2) of Law no. 319/2006.
Who grants the authorization and who is exempt?
The Territorial Labour Inspectorates (ITM) are responsible for authorizing certain legal entities, including those mentioned above. Exempt from this procedure are:
- companies authorized under Law no. 265/2022 regarding the Trade Register;
- sole proprietorships (PFA), individual enterprises, and family enterprises regulated by GEO no. 44/2008.
Obtaining the OSH authorization involves submitting a simple file to the ITM containing key documents on the legality and safety of the activity. The legal deadline for issuing the certificate is only 5 working days.
Attention: serious irregularities can lead to the suspension of the activity, which may only be resumed after deficiencies are remedied and a new authorization is granted.
