New obligations for employers regarding the employment of persons with disabilities from January 01, 2025

Persons with disabilities are those persons who, due to physical, mental or sensory impairments, lack the ability to carry out normal daily activities, requiring protective measures in support of recovery, integration and social inclusion.

Children and adults with disabilities, Romanian citizens, citizens of other states or stateless persons, benefit from the provisions of the legislation in force, during the period in which they have, according to the law, their domicile or residence in Romania.

According to ONG 127/2024, published in the Official Gazette 1124/11.11.2024, new obligations are established for employers in relation to the employment of people with disabilities.

Starting with January 2025, employers must:

– provide evidence that, through a written request, they have requested the support of non-governmental organizations (“ONGs”) which, according to their statutes, provide services for the benefit of persons with disabilities, in order to comply with the 4% percentage established by Law 448/2006;

– to submit to the National Authority for the Protection of the Rights of Persons with Disabilities and the National Agency for Employment:

o (a) written request, and

o (b) proof of its forwarding to the ONG, in order to communicate the vacancies suitable to be filled by people with disabilities. The application shall include the description of the duties for the respective positions, the qualifications required, as well as the working hours.

– to transmit annually, by January 31 for the previous year, to the National Authority for the Protection of the Rights of Persons with Disabilities and the National Agency for Employment, a centralized statement of the positions occupied by persons with disabilities employed and an inventory of the skills required for employment.
