The categories of goods that can be purchased according to art. 6 para.(1) Emergency Ordinance (O.U.G) no. 132_2020

The manner of granting the financial support and the categories of goods that can be purchased according to art. 6 para. (1) of the Government Emergency Ordinance no. 132/2020 on support measures for employees and employers in the context of the epidemiological situation caused by the spread of SARS-CoV-2 coronavirus, as well as to stimulate employment growth, to carry out telework, in accordance with Law no. 81/2018 on the regulation of telework activity, were established by Order no. 1.376 of September 9, 2020, published in the Official Gazette no. 832 of September 10, 2020

The goods that can be purchased according to art.6 of the O.U.G. no.132 / 2020, are provided in Annex 1 to the Order, respectively: 1) laptop/notebook computer systems; 2) tablets; 3) smartphone; 4) peripheral input and output equipment related to the previously provided goods; 5) equipment necessary for the connection to the Internet of the aforementioned goods; 6) licenses related to the operating systems and software applications related to the goods provided in points 1-3 necessary for carrying out the activity in telework regime, in accordance with the provisions of Law no. 81/2018.

Through technological services, within the meaning of art. 6 para. (1) of the O.U.G. no. 132/2020, it is understood the totality of the means afferent to the information and communication technology that the employer is obliged to provide to the teleworker under the conditions of art. 7 lett. a) of Law no. 81/2018.

The procedure consists in the transmission by the employers of by electronic means, respectively by uploading on the platform aici.gov.ro, to the employment agencies of the county or, as the case may be, of the municipality of Bucharest, within whose radius they have their registered office, of the following documents, for which it assumes responsibility for the correctness and veracity of the data entered: a) an application signed and dated by the legal representative (annex no. 2 of the Order); b) a statement on one’s own responsibility, given by the legal representative (annex no. 3 of the order); c) the list of teleworkers for whom the granting of the amount provided by art. 6 para. (1) of the O.U.G. no.132 / 2020 (annex no. 4 of the Order).

Establishing or, as the case may be, rejecting the right of employers to benefit from the amount provided in art. 6 para. (1) of the O.U.G. no. 132/2020 is made based on the decisions issued by the executive directors of the county employment agencies, respectively of the municipality of Bucharest.

Payment from the unemployment insurance budget of the amounts provided in art. 6 para. (1) of the O.U.G. no. 132/2020 is made within the funds allocated for this purpose, in the order of submission of applications, until December 31, 2020, by transfer to the accounts mentioned by employers in the application submitted, within 10 days from the date of registration of complete documentation provided by Order.

Employers have the obligation to send, within 30 days from the granting of the amount, by uploading on the platform here.gov.ro, to the employment agencies of the county or, as the case may be, of the municipality of Bucharest, which have paid the amounts, the following supporting documents, scanned: a) fiscal invoices issued by suppliers of technological goods and services; b) fiscal receipts or receipts or account statements attesting the payment of invoices; c) the records of the materials of the nature of the inventory objects given for the use of the teleworkers, drawn up according to the model provided in annex no. 3 to the Order of the Minister of Public Finance no. 2.634 /2015 regarding the financial-accounting documents, and /or, as the case may be, the vouchers for the movement of fixed assets given for the use of employees, drawn up according to the model provided in annex no. 3 to the Order of the Minister of Public Finance no. 2.634 /2015, and/or, as the case may be, the situation with the technological services that the employer provides to each employee. Otherwise, they have the obligation to reimburse in full the amount granted within 30 days from the date of expiry of the deadline for the submission of supporting documents.
