Ex officio erasure of Authorized Individuals (PFA) with more than 5 classes of activities

According to the legislation in force, several authorized individuals (Authorized Individuals (PFA)) risk being automatically erased (radiated) in the spring of 2019 if they do not modify their activity until mid-January 2019, according to the legislation in force.

The situation of the Authorized Individuals (PFA) who have not fulfilled this obligation was recently published by the National Trade Registry Office (ONRC):

Concrete, Authorized Individuals (PFA who will not modify their pbject of activity until January 17, 2019, will risk being erased ex officio by the National Trade Registry Office (ONRC). According to this institution, there are currently over Authorized Individuals (PFA) who have not complied with a limitation introduced in the legislation nearly two years ago.

In Bucharest, for example, there are 1,827 Authorized Individuals (PFAs) that risk being erased during the spring. There are also other counties that have a large number of independent entrepreneurs who will visit the National Trade Registry Office ONRC) this month and next month.

We remember You that at the beginning of 2017, Law no. 182/2016 introduced a limitation on the number of classes of activities. Thus, the authorized persons can have up to five classes of activities provided by the Classification of Activities of the National Economy (CAEN), provided there does not exist an other limitation until then.

Given that Authorized Individuals (PFAs) have more than five activities, the respective Regulatory Act provides that Authorized Individuals (PFAs) have at their disposal two years in which they can change their object of activity; to have maximum five object of activities. This deadline is January 17, 2019.

If the Authorized Individuals (PFA) do not change their object of activity within the above mentioned term, Law no. 182/2016 provides that, within 60 days of its completion, the National Trade Registry Office (ONRC) will erase them ex officio.

According to a recent announcement by the National Trade Registry Office (ONRC), the erasure will be made starting with March 19, 2019. It means, from the first day after the 60-day deadline.

The same law introduced a limitation of ten classes of Activities of the National Economy (CAEN) – activities for individual enterprises.
