Unitary application of the provisions regarding the granting of days off for parents

The Ministry of Labor and Social Protection (MMPS) informs that a series of amendments submitted by the institution, in order to amend and complete GEO no. 147/2020 on granting days off for parents to supervise children, the effective presence of children in educational institutions and in pre-school early education units, as a result of the spread of the SARS-CoV-2 coronavirus, was adopted by the Specialized Commission of the Parliament.

“I noticed that the regulations regarding the granting of days off for the supervision of children in the situation of limiting or suspending teaching activities applied in a non-uniform case to single-parent families, respectively that some employers granted days off or salary increase and others did not. In order to rectify these situations, we have tabled a number of amendments that have been adopted. Also, the employees of the national defense system, public order, and national security, employees from penitentiaries and staff from public health units will be able to opt for days off or for a salary increase of 75% of the basic salary “, said the minister.

Therefore, for the unitary regulation of the situation of single-parent families, it has been established that the parent requesting days off or the salary increase no longer needs the declaration of the other parent, if he exists/is declared. In situations where these rights have been granted, the amounts paid do not constitute debts and are not recovered.

Another change concerns the employees of the public institutions of defense, public order and national security, penitentiaries, and the personnel of the public sanitary units, who will be able to request either the granting of paid days off or the salary increase of 75% of the basic salary/function balance corresponding to a working day.

“Considering the changes proposed by the Ministry of Education and the Ministry of Health for the courses, the regulation has been adapted so that the number of days off or the number of days related to salary increase will be established according to the period provided by the County Committee for situations of emergency / Bucharest Municipality Committee for Emergency Situations, or the decision of the management of educational units/institutions in case the limitation or suspension of teaching activities is established as a result of illness in the pre-school education unit. If the limitation or suspension of teaching activities that involve the actual presence of children is established by the decision of the management of educational units or institutions, it must be communicated to parents within 24 hours of issuance, including by electronic means of communication, so that parents can submit, in copy, to the employer, in order to request the days off or the salary increase ”, according to the press release of MMPS.
